Terms and Conditions for American Home Supplier
1. General These Terms and Conditions govern the sale of products ("Products") by American Home Supplier ("AHS" or "we") to you, the customer ("Customer" or "you"), including all transactions conducted through our website and direct orders. By ordering any Products from AHS, you agree to be bound by these terms.
2. Product Sales and Specifications All Product sales are subject to availability. Product specifications, pricing, and availability are subject to change without prior notice. We endeavor to display accurate and up-to-date information on our website and in our communications.
3. Payment Terms Payment for Products must be made according to the payment terms specified at the time of order. AHS reserves the right to require payment in full before manufacturing or shipping any Products.
4. Shipping and Delivery AHS is responsible for arranging shipping and will endeavor to meet desired delivery times but does not guarantee delivery dates. Risk of loss passes to the Customer upon delivery of the Products to the carrier.
5. Installation Installation of Products is the sole responsibility of the Customer, unless otherwise agreed in writing. AHS may provide instructions or recommendations, but ultimate installation and use compliance with local regulations are the Customer's responsibility.
6. Returns and Refunds Products may be returned within 30 days of delivery if they are in new and unused condition. Custom orders are non-returnable and non-refundable. AHS reserves the right to charge a restocking fee for any returns.
7. Warranty AHS warrants that the Products are free from material defects for a period of 12 months from the date of delivery. This warranty does not cover damages resulting from improper installation, misuse, or natural disasters.
8. Limitation of Liability AHS's liability for any claim related to these Terms and Conditions, including without limitation, any claims arising out of or related to the sale, delivery, or use of the Products, shall not exceed the total purchase price of the Products. In no event shall AHS be liable for any special, incidental, indirect, or consequential damages.
9. Intellectual Property All intellectual property rights in the Products are owned by AHS. The Customer may not reproduce, reverse-engineer, or create derivative works based on the Products without prior written consent from AHS.
10. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which AHS is incorporated, without regard to its conflict of law provisions.
11. Dispute Resolution Any disputes arising under or related to these Terms and Conditions shall be resolved through final and binding arbitration, conducted in the state of incorporation.
12. Amendments AHS reserves the right to amend these Terms and Conditions at any time. All amendments will take effect immediately upon their posting on the website or direct notification to the Customer.
